By ordering Products through the Site or by mail, email, phone, fax, or any other method, you agree on your behalf personally and on behalf of any entity for which you are an agent or appear to represent to the Terms and Conditions.
Intellectual Property. The Site, and all information (“Content”), printed and electronic, or otherwise experience on the Site, are protected by U.S. and international copyright, trademark and other laws, and belong to E-Z-Hook or its partners. No right, title or interest in any accessed or downloaded Content or materials is transferred to you as a result. E-Z-Hook reserves all of its intellectual property rights in any Content you access or download from the Site. Order Validation and Acceptance. When you place an order, we may verify your method of payment, shipping
address and/or tax exempt identification number, if any, before processing your order. You agree that your order is an offer to buy, under these Conditions, the Products listed in your order. E-Z-Hook at its discretion, may choose to accept your order by processing your payment and shipping the Product, or may, for any reason, decline to accept your order or any part of your order in E-Z-Hook sole discretion. If we decline to accept your order, we will attempt to notify you using the email address or other contact information you have provided with your order. Delivery and/or
shipment dates provided in connection with any order are estimates only and do not represent fixed or guaranteed delivery dates.
Color Display. E-Z-Hook attempts to display as accurately as possible the colors of the Products shown on the Site. However, because the colors you see depend on many factors, including your monitor or printer, E-Z-Hook cannot guarantee that the color you see matches the Product color.
Pricing/Payment/Product information. E-Z-Hook makes every effort to provide current and accurate information related to the Products and pricing, but does not guarantee the accuracy of any such information. We reserve the right to correct any errors, inaccuracies, or omissions at any time. Information relating to the Products is subject to change without notice. Prices are subject to change at any time prior to E-Z-Hook’s completion of your order. In the event E-Z-Hook discovers an error in pricing, we will notify you of the correction, and you may choose to accept or cancel the order. All prices are in U.S. dollars. E-Z-Hook accepts payment by credit card (MasterCard, VISA, American Express, Discover), as well as open account credit to qualified institutions and businesses. Payment must be made in US Dollars.
Taxes: Prices shown do not include any taxes, or charges imposed by any government authority. E-Z-Hook charges sales tax unless you have a valid sales tax exemption certificate on file with E-Z-Hook. E-Z-Hook will not refund tax amounts collected in the event a valid sales tax certificate is not provided. Shipments/ Delivery/Title and Risk of Loss: Shipping or freight charges and insurance will be paid by the customer. All sales are made FOB origin from E-Z-Hook’s plant in Arcadia, CA, USA. Shipping or freight charges from E-Z-Hook are prepaid and added to the invoice, billed collect, or billed to a third party. Title and risk of loss shall pass to you when products are delivered to Carrier. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments. Shipments of excessive weight or size may require additional charges. E-Z-Hook will notify you prior to shipment if these conditions apply. Availability of ship method is dependent on the destination country. The shipping costs will be prepaid and added to your order, and all import licenses, duties, tariffs and brokerage fees will be your responsibility.
Return Policy: E-Z-Hook must be notified within 30 days from invoice date of any discrepancy with order due to shipment error or defective product. No product will be accepted for return or exchange without RMA authorization from E-Z-Hook. For authorized product returns due to customer order error a restocking fee may apply. Based on product type and quantity the restocking fee may be as much as 50%. All custom parts are non-cancelable and non-returnable at time of placement, as are any orders quoted or communicated as such.
Warranty: All products are sold free of manufacturer defects under normal use and service.
Design Change: E-Z-Hook reserves the right to change product design or specifications at any time without notice.
Electronic Communication: When you place an order via the Site, you are required to provide a valid email address, which we may use to communicate with you regarding the status of your order, advise you regarding shipment of back-ordered products, and to provide you with any other notices, disclosures or other communications relating to your order. You agree that E-Z-Hook will not be responsible for any damage you incur, or information you do not receive, as a result of your failure to provide and maintain a valid email address or as a result of any failure of your email system, spam filters, or other impediments to your receipt of our communications.
Indemnification: You understand and agree that you are personally responsible for your use or inability to use the Products. You agree to indemnify, defend, and hold harmless E-Z-Hook against all claims, losses, expenses, damages and costs, and reasonable attorneys' fees, resulting from or arising out of your use, misuse, or inability to use the Products, or any violation by you of these Conditions of Order.
Force Majeure: E-Z-Hook will not be liable for delays in delivery or for failure to perform its obligations due to causes beyond its reasonable control. E-Z-Hook’s time for delivery or performance will be extended by the period of such delay or we may, at our option, cancel any order or remaining part thereof, without liability, by giving notice to you.
Changes to the Terms and Conditions: E-Z-Hook reserves the right to change the terms of these Terms without notice. You are responsible for reviewing these Terms of Use prior to accessing, browsing, or using any part of the Site. Your continued use of the Site, or its Content acknowledges your agreement to the then current Terms and Conditions. In the event that a change or update is made to these Terms of Use, the “Date of Last Modification” will be updated accordingly.
